DraftKings Legal States (Where is DK Sportsbook legal?)

DraftKings Sportsbook first went live in 2018 and has since launched in many states across the United States. That said, it’s not available in every state due to state-specific regulations.

You may be familiar with DraftKings as a daily fantasy sports platform. While that’s available in most states, it’s different for the online sportsbook.

In this guide below, we’ll discuss all DraftKings legal states, answering the question of “Where is DraftKings legal?” and so much more.

Where Is Draftkings Legal In 2026?

DraftKings is an online gaming entity that offers daily fantasy sports (with lineup creation and Pick6), online casino play, and, of course, online and retail sports betting.

Across those three platforms, some form of DraftKings is available in all but Nevada, Idaho, Hawaii, and Montana.

That said, below, I’ll dig into the question: “What states is DraftKings legal in?”

As of Feb. 2026, there hasn’t been a lot of movement since Missouri launched legal online sports betting. There are some other states, like Rhode Island, that could allow more sportsbooks to launch.

Other states, such as Alaska, Alabama, Georgia, and Hawaii, have introduced legislation in the past.

Finally, Minnesota passed legislation in 2022, but disagreements between tribal communities and racetrack operators have prevented a defined launch date. That said, it could be in 2026.

Is Draftkings Legal In Florida?

No. While online sports betting is legal in Florida and has been since November 2021 (and re-launched in 2023 after a dispute), the state has a deal with the Seminole Tribe, which controls Hard Rock.

Thus, the only online sports betting platform in Florida is Hard Rock Bet.

As for daily fantasy sports, you can play DraftKings in Florida.

Is Draftkings Legal In California?

No. California has had legislation on the books in the past, including bills that made it to the November 2022 ballot, but neither passed. In 2025, no legislation was proposed, and it’s unclear when/if it will happen.

While the sportsbook isn’t available, DraftKings DFS is.

Is Draftkings Legal In Texas?

No. A bill was filed in 2023, but there was no movement. In December 2025, Lt. Governor Dan Patrick said he was “simply not there yet” regarding legalizing sports betting.

The Texas Legislature doesn’t meet in even-numbered years, such as 2026, so we’ll have to wait until 2027 to see if there are any changes in sentiment regarding sports betting in Texas.

Texas may not have sports betting for quite some time, but Texans can enjoy DraftKings DFS in the meantime.

Draftkings Mobile App Availability By State

You can wager online with the DraftKings app in the following states: Arizona, Colorado, Connecticut, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Missouri, New Hampshire, New Jersey, New York, North Carolina, Ohio, Oregon, Pennsylvania, Tennessee, Vermont, Virginia, Washington, D.C., West Virginia, Wisconsin, and Wyoming.

Before attempting to wager on the mobile app, DraftKings Sportsbook will use geolocation software to determine your location. This is what every mobile sportsbook does to confirm you’re in the state you claim to be in.

How Draftkings Determines Legal Access

Legal access for DraftKings Sportsbook begins with state-by-state regulation.

Once sports betting is legalized in a state, the state has the appropriate governing bodies, such as a Gaming Control Board, to set sports betting rules, including how many mobile licenses to grant and how that’ll be implemented. This could be one license per retail sportsbook, or multiple per retail sportsbook.

From there, DraftKings will work to partner with a retail-based outlet, if applicable. In states like Tennessee, where there is no retail sports betting, DraftKings Sportsbook will seek to obtain a license to operate as one of the state’s online sportsbooks.

Can You Use Draftkings While Traveling?

Yes, but it depends on where. For example, if you reside in New Hampshire and are traveling to Maine, that’s OK, as both states offer DraftKings Sportsbook.

However, if you’re going from New Hampshire to Florida for vacation, you’ll be unable to use it.

DraftKings Sportsbook operates based on geolocation, so even if you’re a resident of New Hampshire, you’ll be unable to use it in a state where it’s not legal.

That said, again, if you’re traveling to another state where DraftKings Sportsbook is available, you can simply log into your account and play as if you were at home.

Is Draftkings Safe And Regulated In Legal States?

Absolutely. DraftKings is the largest online sports gaming platform in the United States, offering daily fantasy sports contests since 2021.

It uses SSL encryption to protect all of your personal data, including payment information.

You can also access Responsible Gaming tools, such as viewing your states (wagers, money lost, etc.), a check-in reminder, alerts on how long you’ve been playing, and setting limits for deposits, losses, time, wagering, and more.

There’s also a cool-off period, self-exclusion, and bet blocker.

Finally, Sportsbetting 101 offers a guide to help you learn more about sports betting and how it works.

Will Draftkings Expand To More States?

While there’s no clear path for 2026 expansion, it’s only a matter of time before most other states that don’t offer legal online sports betting eventually do.

In 2026, Minnesota is a possibility if a deal is reached with the tribal nations.

Additionally, if Rhode Island were to allow additional sports betting options, DraftKings, based in nearby Massachusetts, would be a clear candidate to launch there.

Draftkings Legal States: Final Verdict

While DraftKings Sportsbook isn’t available everywhere, it’s available in some form in 30 states. Of those 30, 28 offer only online sports betting, while two offer retail sports betting without an online option.

If you’re not in one of those 30 states, unfortunately, you’ll need to wait until other laws are passed, but even then, in most of the states where DraftKings isn’t available, DFS play is.

As time goes on, expect the DraftKings legal states list to continue to grow.

Draftkings Legal States FAQ

What happens if I try to bet in a restricted state?
If you attempt to wager in a restricted state, DraftKings won’t allow it, as its geolocation software tracks your device and determines whether you are in a legal state.
Can I sign up at DraftKings in one state and bet in another?
Yes, but it depends on what combination of states you’re referring to. For example, if you live in Texas, yes, you can create a DraftKings Sportsbook account. However, you just can’t bet. That said, if you make the account in Texas and then travel to Indiana, you’ll be able to use that account and wager. With that, you may be able to access any DraftKings no deposit bonus in Indiana, should one be available.
